Terms of Use

These Terms govern your use of Eloquent. The service operator and contact details are identified in the Privacy Policy. By creating an account or using Eloquent, you agree to these Terms and the Privacy Policy. On Apple platforms, Apple’s Standard Licensed Application End User License Agreement also applies; if these Terms conflict with that agreement for an Apple-distributed copy, the Apple agreement controls to the extent of the conflict.

Age and eligibility

Eloquent does not impose one global minimum account age. You must be legally able to agree to these Terms where you live. If applicable law requires permission from a parent or guardian, you may use Eloquent only with that permission. Eloquent does not ask for your birth date or country inside the app. Store age ratings describe content suitability and may be enforced through device-level parental controls.

Your account

You are responsible for activity under your account and for keeping your sign-in methods secure. Tell us promptly if you believe your account was compromised. One person may not use repeated accounts to obtain repeated introductory offers.

Subscriptions and trials

Eloquent Pro may be offered as a weekly, monthly, or yearly auto-renewing subscription that provides ongoing access to the Pro features described on the purchase screen. The purchase screen displays the subscription title, duration, actual localized price, billing period, taxes where shown by the provider, introductory-offer eligibility, and renewal terms that apply to you before purchase. Any free trial is available only when the store confirms eligibility. When a trial ends, the subscription automatically converts to the displayed paid plan unless cancelled before renewal under the timing stated by your store. Your account is charged through the store or billing provider used for purchase. You can manage or cancel an Apple subscription in your App Store account settings, and other subscriptions through the management link shown in Eloquent or the applicable provider. Deleting your Eloquent account does not cancel a subscription. Restore Purchases is available for supported purchases. Existing accounts with saved Library content or recorded app use retain access to their Library and Word of the Day when a subscription is inactive; AI features require an active subscription and AI permission.

Refund Policy

Except where law or the applicable store permits otherwise, purchases are final and refund requests are handled by the store or billing provider. For help locating your purchase or provider, contact support@eloquent-app.com.

Learning and AI content

Eloquent uses AI to generate learning content, including definitions, translations, example sentences, related words, fun facts, images, and coaching responses. AI can make mistakes and may produce inaccurate, incomplete, misleading, or outdated content. Generated content is not guaranteed to be correct or individually reviewed by a human. Verify important information with reliable sources, and report errors through Support. Eloquent is an educational aid, not professional, legal, medical, or financial advice. Remote AI features require the explicit AI-processing choice shown during onboarding and can be switched off later in Settings.

Acceptable use

Do not use Eloquent to break laws; harm, exploit, or sexualize minors; create hateful, violent, or abusive material; infringe intellectual property or privacy; upload malware or secrets; probe or bypass security or rate limits; automate abusive access; resell the service; or interfere with other people’s use. We may reject unsafe content and restrict or terminate abusive accounts.

Your content

You retain rights you have in content you submit. You give us a limited license to host, process, transmit, and transform it only as needed to provide the features you request, sync and store your content, keep the service secure, and provide support. You must have permission to submit it.

Ownership

Eloquent and its licensors retain all rights in the app, service, branding, software, and content we provide, excluding your content. These Terms give you a personal, limited, non-exclusive, non-transferable, revocable right to use Eloquent for its intended purpose. They do not transfer ownership or permit copying, reverse engineering except where law expressly allows it, sublicensing, or commercial exploitation.

Optional analytics

During onboarding, Eloquent offers one optional choice that enables product analytics and privacy-masked, sampled Session Replay together. You may instead continue with AI only, and you can withdraw analytics and replay later in Settings. These features and their controls are described in the Privacy Policy. Declining them does not prevent use of Eloquent’s core learning features.

Availability and changes

We may change or discontinue features, providers, pricing for future billing periods, or supported regions. We will provide notice where required. We do not promise uninterrupted or error-free availability.

Termination and deletion

You may stop using Eloquent at any time and request account deletion. We may restrict accounts that violate these Terms or create security or legal risk. The deletion recovery and retention process is described in the Privacy Policy.

Governing terms

Mandatory consumer protections in your country remain unaffected. Otherwise, these Terms are governed by the laws of Serbia, without regard to conflict-of-law rules, and disputes may be brought before the competent courts in Serbia. If any provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. These Terms and the documents they incorporate are the agreement between you and us about Eloquent.

Changes

We may update these Terms for product, legal, or security reasons. We will update the effective date and provide additional notice or request renewed acceptance when required. Changes apply prospectively.

Disclaimers and liability

To the extent permitted by law, Eloquent is provided “as is” without implied warranties. Nothing in these Terms excludes rights or liability that cannot legally be excluded. To the extent permitted by law, Eloquent is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the service.
